Our Terms of Sale
Please read these Terms of Sale (“Agreement”, “Terms and Conditions”) carefully before making a purchase through http://www.theflowercrate.co.nz operated by The Flower Crate . Last updated 20/4/2017
All prices quoted on our website are in New Zealand dollars (NZD). If you make a purchase using a credit card or Paypal your account will be charged in NZD.
The Flower Crate currently operates a subscription service in conjunction with a one off service. Minimum sign up is for 4 deliveries in order for you to sample the full experience of The Flower Crate. You can cancel or pause at any time after your first 4 deliveries. When cancelling we do ask that you give us a week’s notice by phone or email where possible.
Subscribers who have set-up their payments via our website are able to manage their subscriptions through the subscriber log-in. Here you can pause, cancel, change (frequency & product selection) your subscription with us yourself at the click of a button.
Payments for subscriptions are normally taken on the same day of the week as your first payment at the frequency you have selected. If we have not received your funds prior to the delivery date and have not had contact with you then you may not receive your delivery. For any payment enquiries please contact us.
If the recipient is not at the address specified when a delivery is made, we will do our best to leave the product in a safe location. If we do leave the delivery in what we believe to be a safe location, we will not be liable if it goes missing or is lost or damaged.
If we can not contact you and there is nowhere to leave the flowers (as in the case for apartment deliveries) we will unfortunately need to pass on the $20 courier fee charge in central Hamilton to redeliver after hours or the following day. Alternatively, If you would like, you can pick the flowers up from our store that evening or the following day.
It is your responsibility to contact us in response to our attempts to contact on your market day of choice and let us know what you will do in terms of the redelivery/pick up of your selection. The $20 fee for redelivery will be charged to your credit card.
We will deliver your flowers free of charge on the market day specified in your subscription with us. Currently the markets operate on a Monday, Wednesday & Friday. The markets are not open on public holidays so if your scheduled delivery date falls on a public holiday we will deliver on the next available market day. We will endeavour to contact you in advance to remind you prior to this occurring.
We take great care and pride to ensure our flowers are of the highest quality. If in the rare occurrence you receive a damaged or unsatisfactory goods please contact us immediately via email firstname.lastname@example.org or telephone 07 8566 416. We will provide a full refund, or replacement flowers if available.
By purchasing from The Flower Crate you agree to be automatically added to our (e-mail) mailing-list. You can unsubscribe at any point using the link in our newsletter or mailing list emails – you can also unsubscribe by e-mailing us email@example.com with “unsubscribe” as the subject header.
Provision of Information
When you use the Website to purchase any products you will be required to provide certain information. You agree and warrant that:
- (a) You will not use any false identities or personas and must provide us with your full legal name and current details;
- (b) All information provided by you will be true and correct in all respects at the time it is given;
- (c) You are responsible for ensuring that all information which is necessary to process any uncompleted sale transaction is kept up to date at all times, and will provide details of any changes to The Flower Crate.
Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
